Preamble

  1. Welcome to Studio-Krush.com Website (the “Website”) (“We” / “Us” / “Our”).
  2. The headings in these Terms and Conditions (the “T&C”) are for convenience purposes only and shall not have any legal meaning or effect.
  3. Please read these T&C carefully, as any use of the Website is subject to them, and you will be legally bound by them.
  4. If you do not agree to these T&C (or any part thereof), we ask you to immediately stop from any further use of the Website.
  5. By using this T&C, you represent that you are over the age of 16. If you are above the age of 16 but under the legal age in the jurisdiction appliable to you, any use of the Website is subject to your parent or guardian consent. By continuing using the Website, you represent that such consent has been obtained.
  6. Any use of the Website shall be for legal purposes only. Any illegal action or action that may damage the proper function of the Website is strictly prohibited.
  7. We reserve the right to change, amend and update these T&C from time to time, at Our sole and absolute discretion. The T&C that are binding to you shall be the updated T&C at the time of use of the Website. It shall be your responsibility to check and recheck the T&C and see if they have been updated, at any entry to the Website.


Terms of Sale

  1. When you make a purchase on the Website, you will be required to provide certain information including your name, phone number, email address and others. You will also be required to provide valid details of an international credit card (or such other payment alternatives, as may be available from time to time on our Website), which you are legally entitled to use.
  2. Any purchase will be subject, in addition to the applicable terms of this Website, to: (a) the relevant policy of the credit card company, clearing company or other payment method company (such as PayPal, Apple Pay, or Google Pay if available on the Website); and (b) their authorization of the transaction.
  3. Upon placing an order on the Website, you will receive an order number. An order number shall not mean a confirmation of the transaction, as all transactions should be approved by Us through a designated confirmation email. We may be decline, restrict, or authorize any transaction, at our sole discretion, including when we find errors regarding the order or the details of the item.
  4. A confirmation of the order will be sent to you via the email address you provided at the time of placing the order. In the event that such confirmation was not received, please contact Us at:  studio@krush.co.il.
  5. Unless you choose independent pickup of your order, all orders will be supplied by a third-party delivery company, at Our choice and at Our sole discretion. You can find more details about our return Shipping & Return Policy here (including pricing and delivery schedules). We shall not have any responsibility over the schedule of the delivery, including delays that are due to your failure to fill in correct and complete manner all information required, or due to your failure to coordinate the receipt of the delivery. The date and time of delivery shall be directly coordinated by you and the shipping company, and you shall make sure your availability to receive the item.
  6. If the event that the order is not authorized by the relevant credit card / clearance company / other payment provider, we will notify you via the email address you provided. In any such event, the order will be automatically declined, and the items will not be saved.
  7. If you wish to return an item, kindly read about our Return Policy here.
  8. Our inventory changes from time to time. In the event that a certain item is not currently available, and We cannot supply it, any transaction placed for such item shall be declined and We shall refund you against such item.
  9. We reserve the right to decline any orders from any customer with whom we have an ongoing dispute regarding a prior order.


Prices

  1. All prices shown on our Website include Israeli tax at the applicable rate. For purchasers outside of Israel, prices are shown in USD. If you wish to purchase in Euro currency, the final price of any items you purchase will be calculated in accordance with the applicable exchange rate on the date and time when the payment provider processes your payment.
  2. Delivery charges are calculated in accordance with our Shipping & Return Policy. 
  3. Although We try to make sure the information on our Website is accurate and clear, it might be the case that some of the information on the Website will be incomplete or have unintentional errors or omissions. We will not be responsible for any such errors.
  4. We reserve the right to update the prices of the items on the Website from time to time, and the delivery costs, without pre-notice. The effective price shall be the one presented at the time an order is placed.


General

  1. There might be slight changes between how the items are presented on the Website and how they are in real-life (including minor changes in coloring or texture). For avoiding mistakes, please read the items’ details and specification before placing an order. You can also contact our Customer Service on studio@krush.co.il concerning a specific item.
  2. We may offer, from time to time and at Our sole discretion, to some or all of Our clients, different benefits. These benefits will be subject to the applicable terms as will be specified further to you. You should read all specifications carefully.
  3. Any error, caused due to force majeure or for any reason beyond Our reasonable control, will not be considered as a breach of these T&C and will not give raise to any claim or remedy to you.
  4. We reserve the right to restrict, prevent or shutdown the access to the Website for users that have breached any of these T&C, applicable laws and regulations or if they have made unauthorized, illegal, immoral or defamatory use of the Website or in Our brand name. We shall not be responsible in such cases, for any damage that may be caused to you as a result of such actions.
  5. We reserve the right to assign and transfer any of our rights herein, to any third party and at our sole discretion.
  6. IN ANY EVENT AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE RESPOONSIBLE FOR ANY CLAIM, ERROR, OMMISSION OR ACT BEYOND THE EXTENT OF THE SCOPE YOU MADE PURCHASES ON THE WEBSITE. WE SHALL NOT BE RESPONSIBLE FOR ANY CONSEQUINTIAL DAMAGE OR LOSS CAUSED TO YOU (DIRECT OR INDIRECT) FOR ANY REASON WHATSOEVER, RESULTING FROM YOUR USE OF THE WEBSITE.
  7. We are committed to not sharing your personal information with any third parties.


Social Media and IP

  1. All trademarks, trade names, trade masks, tradedresses, domain name, logos, copyright, slogans, passwords, designs, images, images, design patterns, fonts, videos, and content that are subject to intellectual property rights on the Website or as part thereof, shall be exclusively owned by Us (or third parties authorizing Our use). You shall have no right to them and are restricted from doing any use of them.
  2. The designs shown on the Website are unregistered designs, protected by the Israeli Design Law.
  3. You shall not: copy, duplicate, publish, make derivative works of, or take any commercial action, not explicitly permitted by Us in writing, in Our intellectual property and in the content appearing on the Website.
  4. Any use of the hashtags: #MYKRUSH or a tag/mention of our Instagram page: @krushkerengrinfeld or @krush_studio, on social media (including IG, TT, YU, FB and X), shall serve as your consent for Us to use that content for Our own commercial and marketing needs, at our sole discretion. By using these tags, you hereby waive any claim of IP infringement against Us, including in relation to copyright and moral rights and any publicity or privacy claim associated therewith. 


Your further obligations

  1. You agree that any of your use of the Website shall be in accordance with these T&C and for legal purposes only.
  2. You shall indemnify, hold harmless and protect Us against any damage, expense or claim with respect to your lack of compliance with these T&C.
  3. You agree that any purchase made on the Website shall be for personal use only. No wholesale is permitted.
  4. With your receipt of the items, you are required to check their proper fit, size and other details, at your sole responsibility. In the event of a defect or mistake, please follow our Shipping & Return policy.


Applicable Law and Jurisdiction

  1. These T&C’s shall be governed by and interpreted in accordance with the laws of the state of Israel. The Tel Aviv courts shall have sole jurisdiction over any dispute arising of or related to this agreement.


Return, Replace and Cancellation Policy


At KRUSH, we hope that you will complete your order and receive your item and find it’s a perfect match!

If, however, you purchased an item and wish to replace or return it, please read these instructions carefully, as they shall apply on any such replacement or return order.

Any costumer who purchased an item they would like to return, may choose to get a refund or credit, subject to the terms herein:


Cancellations and Returns

  1. You can cancel a transaction that was approved on the Website within 14 days as of receipt of the items, in accordance with the applicable Israeli Consumer Protections Laws. Please note that this shall not apply to custom-made purchases, if available (such items will be non-refundable).
  2. If the transaction was cancelled while the item is still in our possession, you will get refund for the transaction, according to applicable laws and regulations.
  3. If the transaction was cancelled following receipt of the item, you are required to return the item to us on your expense through our delivery company only or if you wish to physically return the item in-person, to Krush Studio (information will be available upon request).
  4. in the event of a refund, if the item is no longer in our possession, you are required to return the item to us on your expense through our delivery company only or if you wish to physically return the item in-person, to the following address: Hazeitim 96, Givaat Shmuel, IL
  5. Please note that in the event that the items have already passed to the delivery company, the shipping cost will not be refunded.
  6. If a purchase was made via a voucher, you can only get store credit, and not a refund.
  7. If an item was purchased as part of a promotion that included other items to receive such benefit, you can return the item and receive the item’s worth value as part of such promotion (for example, if you purchased an item as part of a promotion of 30% off the second item, and you wish to return the item that was 30% off, you will receive store credit for the amount of the item after the promotion applied to it). This will be only applicable to items that are returnable subject to this policy.
  8. The refund will be provided to the credit card / other payment method you purchased with that the transaction was made through, within 30 business days as of the day when the items were received at our facilities, and subject to the credit card company’s policy.
  9. You can only return undamaged items in their original box with the tag attached to the item (if the item included a tag).
  10. If the cancellation is due to: (a) a defect in the item (not caused by you or by natural wear and tear); or (b) a mistake in the model, size or color that was presented on the Website at the time of purchase and the item received.
  11. Notice of cancellation request of a transaction is possible via email: studio@krush.co.il.
  12. A cancellation or return notice must include all details of the transaction, including order number; description of the returned item; ID; payment method; and if such cancellation request was provided by phone – an additional identifiable information.
  13. In any event, and notwithstanding the above, any item that was specially and custom made for you (including modifications to a specific model available), are not returnable, refundable, or exchangeable.
  14. Refund for taxes paid, shall be at your sole responsibility.
  15. Please note that some cancellation fees may apply, as applicable under the Israeli Consumer Protection laws.


Exchange and Refund:


In addition to the above policies, any customer who wishes to exchange a purchased item with another, can do so, subject to the following:

  1. Exchanges are possible until 30 days as of receipt of the item, only for items that have not been used and are undamaged at their original box (and tag attached, if available).
  2. You must submit an exchange request by using this mail: studio@krush.co.il and include the item you wish to exchange to. If the new item requires additional payment, you will be required to pay so. All exchanges are made through our delivery company, and are subject to the applicable fees to be paid by you.
  3. Any and all vouchers shall be valid for 24 months after it was issued to you.
  4. No exchange possible against vouchers.

This shipping and return policy is subject to our general T&C’s and is governed by the laws of Israel.

Shipping


  1. Shipping is available through third party courier and will be subject to the applicable courier’s terms and conditions Isgav for domestic shipping (Israel) and ICL for international shipping. 
  2. For domestic (IL) orders of or over 100USD  shipping is free of charge. (please note that if you were awarded free shipping and then return an item that without its purchase you would have to pay for shipping, the shipping cost will be deducted from your return amount voucher). Standard domestic delivery is expected to arrive within 9 business days. Purchased under USD 100 will offer delivery within 9 business days at the cost of USD 8.
  3. International Shipping: international shipping is available for the jurisdictions specified below: UK, US, EU and other territories that are available on our websit. International shipping will be available through ICL and are subject to ICL’s terms and conditions. International shipping will be charged USD $30 for regular shipping (standard delivery within 21 business days) and USD $35 for express delivery within 9 business days. Orders above USD $100 will be awarded free regular (standard) shipping.
  4. You may also choose independent pick up from our Studio during our normal opening hours. If you wish to do so, please choose “pick up” as the method of shipping at the checkout page. Your order will be available for pick up within 9-12 business day. We will let you know through the email address you entered during checkout once it’s ready for pickup! Make sure to bring your confirmation email with you.
  5. You will be solely responsible for making sure all information you provided regarding the delivery is accurate and updated. It is your sole responsibility to make sure you are available to receive the item.
